App Terms & Conditions
Please note that these terms are subject to change without notice, so it is your responsibility to review them regularly. Our App is controlled and operated by WeDoTransformations.
1. What is this document about?
The purpose of these Terms and Conditions of Use (hereinafter "T&C") is to inform you about the terms of use applicable to all actions carried out in the App. You must read and understand them before using the functionalities of the App. As a User, you declare and understand that by logging into the App you accept the T&C and will be bound by them.
The applicable terms will be those in effect at the time you log in. If you do not agree with these T&Cs, you must refrain from using the App. It is forbidden to access it from territories where its content is illegal, its misuse, falsification or impersonation and fraudulent activities in it.
2. What do you need to know to access the features of the App?
Users will be able to download the App from the App Store (iOS), Play Store (Android) and AppGallery (HarmonyOS).
The App may be used by Users who have their Pointpal account in an active state. Accounts that are in a blocked state will not be able to use their Points. To know the different statements of the accounts, the User must consult the Program Regulations that are published in the App.
The App is aimed exclusively at natural persons, of legal age, with an identity document, depending on the territory where WeDoTransformations is developed.
3. What are the features available in the App?
Users of the App will find the following functionalities:
New User Registration
New Users who want to belong to the Program must register and can do so through the App, going through an identity validation process for the security of their information and their Points. Registration may be carried out by any natural person, of legal age, duly identified. The exclusions that may be presented for registration and other conditions must be consulted in the Program Regulations, which are published in the App, which reserves the right to register, access, use and exclusion from the Program. All Users who register must authorize the processing of personal data, provide or complete the data requested for this purpose, at least name, surname and email address. Once a new User has filled in the mandatory data requested in the form and confirms that they are correct, they will be registered in Pointpal and will then be able to log in to the App that will allow them to enjoy the benefits granted by the Program. Users who register on the App are required to log in in order to enjoy the Points they earn in the Program.
Users with an active account in the Program must have access to their email, where they will receive an authentication email to log in and be able to access all the functionalities available in the App. When a user logs in to the App at least once, regardless of whether they are logged in or out, they are identified as an App user. The device from which you have logged in will be associated with the WeDoTransformations user's account.
Please note that WeDoTransformations, for the security of App Users for some sensitive transactions such as: Registration, login, data update, among others, may send an email to the User, who must enter said email in order to carry out the authentication process. If the User for any reason does not have access to the email or fails in the validation process, he/she must contact the WeDoTransformations service channels to update them.
Account management and control
WeDoTransformations may notify Users through the App of account-related information, data updates, changes to the Program, accruals, redemptions and commercial information. Users who do not wish to receive any type of notification through the App must deactivate notification permissions from the device's settings, bearing in mind that the deactivation that is being carried out is related to push notifications. WeDoTransformations may continue to contact you through the other contact details that the User has registered in the Program, as long as you have the respective authorizations active.
Users will be able to keep the session active in the App, with this they will be able to stay informed of the benefits and news offered by WeDoTransformations. When a User logs out of the App, they will continue to be identified as a user of the App, and will need to authenticate their email to redeem the Points in the physical stores of the Active Coaches and service channels.
Users are responsible for updating the App when instructed to do so by WeDoTransformations. The use of outdated versions could affect its proper functioning or that of the mobile device where it is downloaded. WeDoTransformations will inform you when an update is available, some of these may be mandatory and restrictive, i.e. if the User does not make them, they will not be able to continue using the App.
A User will be terminated and considered a NON-App User in the following cases:
Information on how to accumulate and redeem Points and the Program's Active Coaches.
In the App, Users will find in the App, the consumption history and the number of points they have. In addition, you will be able to view the products available in the Active Coach's food club.
In the event that Pointpal withdraws or adds new Active Coaches, it will inform you through the App, so that Users are kept informed.
Redemption of Points on products and services available on the Pointpal App
Users will be able to use their accumulated Points by presenting their QR code or sharing the registration email in the Pointpal app.
Recommendations for the enjoyment of the Program and/or exclusive benefits for users of the App.
The App will publish products and services that can be purchased online and others that will only be presented to inform Users of the offer available to the different Active Coaches. The User must go to the place where the product is located, if applicable, according to the publication. In some cases, products and services may be presented with offers for a limited time, in each publication the applicable Terms and Conditions will be informed. Educational content and recommendations may also be published for the enjoyment of the Program.
WeDoTransformations may grant exclusive benefits to Users of the App, or to a specific segment, who will be informed through Push notifications in the App, email, SMS, call or direct mail.
Access to WeDoTransformations service channels
The user of the App will be able to access a help center with general information about the Program and consult the Legal Documents related to the operation of the Program. You will also be able to contact WeDoTransformations to resolve any concerns through the service channels provided by WeDoTransformations.
WeDoTransformations may at any time delete, modify or include new functionalities in the App, which will be informed through it.

WeDoTransformations will make every effort to ensure that the operation of the App does not present errors or interruptions, however, due to the quality of the activity, it depends on other factors that may affect and cannot be controlled by WeDoTransformations. On the other hand, the access of Users may be suspended or restricted for the purpose of making improvements, maintenance, repairs or updates. WeDoTransformations is not responsible for losses that may be due to loss of profits or loss of business opportunities, any type of indirect damage or damages arising from issues other than the breach of its obligations. Under no circumstances shall WeDoTransformations be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of or inability to use the App, including, but not limited to, damages arising out of your reliance on information obtained from the App that results in errors, omissions, interruptions, deletion or corruption of files, viruses, delays in operation or transmission, or any other type of failure in performance, even if the User has been advised of the possibility of such damages, or for any claim of third parties, except as expressly provided herein. WeDoTransformations assumes no responsibility for problems or inability to use the App, including, but not limited to, events such as server or connection problems, communication interruptions or technical problems. In the event that the use of the material in the APP results in the need to service, repair or correct equipment or information, the User assumes any costs derived therefrom.
WeDoTransformations warns its Users that the information in the App may contain errors or inaccuracies, be incomplete or up-to-date. Therefore, WeDoTransformations reserves the right to correct any errors, omissions or inaccuracies, change or update it at any time and without prior notice.
In addition, WeDoTransformations warns that the Pointpal App only has the function of awarding Points to Users, as a reward for their loyalty, in accordance with the purpose of the Pointpal. However, the WeDoTransformations relationship is limited to transmitting to the Users the Points obtained for the acquisition of products or services of the Active Coaches, so that the commercial relationship and, therefore, any responsibility derived from such acquisition will always fall on the Active Coaches. At no time shall WeDoTransformations be liable for any kind of indirect damages or damages arising from the products or services offered by the Active Coaches.
7. What do you need to know about intellectual property?
All computer, graphic, advertising, photographic, multimedia, audiovisual and/or design material, as well as all contents, texts and databases (hereinafter "the Contents"), made available to you in the App are the exclusive property of WeDoTransformations, or in some cases, of third parties who have authorized their use and/or exploitation. Likewise, the use of some content owned by third parties is expressly authorized by law and is protected by the rules on copyright, trademarks and by all applicable national and international regulations. Any act of copying, reproducing, modifying, creating derivative works from, selling or distributing, displaying, among others, the Contents, in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording or any other means, without the prior written permission of WeDoTransformations or the copyright holder, is prohibited. Under no circumstances do these T&Cs confer rights, licenses and/or authorizations to carry out the acts described above.
Any unauthorized use of the Contents will constitute a violation of these T&C and the current regulations on trademarks, copyrights and/or other applicable national and international intellectual property regulations, giving rise to the corresponding civil and criminal actions. WeDoTransformations grants you a personal, non-transferable and non-exclusive license and right to display the App Content on the screen of your device, or digital assistants under your control.
With respect to the companies, products and/or services that are advertised in the App, as well as the links, WeDoTransformations does not play any role in the production of these products and/or the provision of services and does not constitute any guarantee, express or implicit, of their content or their suitability for a particular purpose. In this order of ideas, when the use of a product and/or service is suggested, it is the exclusive autonomy of the User to decide its use, and therefore WeDoTransformations does not assume any responsibility for any direct or indirect damages, certain or eventual, past, present or future, that may arise from such use. In this way, the transactions that the User carries out with third parties outside the App based on the advertisements of products and/or services, as well as the visits made to their website through the links, will be under their exclusive account and risk, without in any way compromising the responsibility of WeDoTransformations.
8. What do you need to keep in mind when registering?
In line with the provisions of these terms and conditions, during the download, installation and use of the App, activities that constitute the processing of personal data will be carried out, such as the collection, processing, storage, transmission and disposition of the User's personal information by WeDoTransformations, which holds the status of responsible for the processing of personal data under the terms of national and international laws. Such processing will be carried out in accordance with the terms described in its personal data processing policy, which can be found in the legal documents section of the App, with the following specific provisions being additionally applicable: Types of personal data processed: For the proper use of the App, as well as for the development of its functionalities, the App will collect the following types of personal data:
In accordance with the applicable regulatory provisions on the protection of personal data and other regulatory and complementary rules, depending on the country in which you are located, the User has the right to request the updating, correction, modification or deletion of personal information, as well as to request the cancellation of the authorization or partial processing of the personal data, provided that there is no legal or contractual duty that requires its retention. The Program has provided the following e-mail address: info@wedotransformations.com, as well as the other channels described in its personal data processing policy. Through these channels, Users may submit their queries and claims associated with the protection of their personal data or the exercise of the right of habeas data.
By downloading, accessing and using this application, the User authorizes, in a prior, express and informed manner, the authorization of this processing of personal data in terms previously described, declaring to know and accept the personal data processing policy of WeDoTransformations as the responsible party for their personal data.
9. What is the law applicable to these T&Cs?
These T&C shall be governed by and interpreted in accordance with the national and international laws on the matter, applicable to the country to which the User belongs. However, as it is an App, any dispute arising from this document will be submitted to the competent courts in accordance with the legislation of the country where the use of the App is authorized, and both WeDoTransformations and you expressly waive any other jurisdiction that may correspond to you by reason of your present or future domicile.
Please note that in the event that one or more of the provisions contained herein shall be held to be void, illegal or ineffective in any respect, the validity, legality and enforceability or effectiveness of the remaining provisions herein shall not be affected or nullified by such circumstance.
10. Are there any service channels for the solution of requests, complaints, claims and suggestions?
Any request, complaint, claim or suggestion must be sent to the info@wedotransformation.com mail.
When you register a PQRS, WeDoTransformations may ask you for the necessary support to address your request, complaint, claim or suggestion. If this documentation does not exist, WeDoTransformations will consider the information that exists in the Program's system to be valid.
